Terms & Conditions

Services Provided

1. The Client hereby agrees to engage ATW Creations to provide the Client with services (the “Services”) consisting of:

 

    • ATW Creations will design wedding stationery for the Client (the “Designs”)

 

    • At request (and subject to additional costs) ATW Creations can arrange for the Designs to be printed (the “Prints”)

 

2. The Services will also include any other tasks which the Parties may agree on. ATW Creations hereby agrees to provide such Services to the Client.

 

Term of Agreement

3. The term of this Agreement (the “Term”) will begin on the date of this Agreement and will remain in full force and effect until the completion of the Services, subject to earlier termination as provided in this Agreement. The Term may be extended with the written consent of the Parties.

 

4. In the event that either Party breaches a material provision under this Agreement, the non-defaulting Party may terminate this Agreement and require the defaulting Party to indemnify the non-defaulting Party against all reasonable damages.

 

5. In the event that either Party wishes to terminate this Agreement prior to the completion of the Services, that Party will be required to provide 10 days’ notice via email or in writing to the other Party. 

 

Information provided

6. All information provided by the Client to ATW Creations will be proof read by the Client, and ATW Creations is not liable for any errors contained within the original information provided by the Client.

 

7. ATW Creations cannot be held liable for any designs or information which are signed off (all approvals must be provided in writing, which includes emails) and subsequently are found to be incorrect. 

 

Wedding day stationery

8. You will be notified by ATW Creations of a cut off date by which all stationery items need to be approved for print. This date must be met in order for your order to be fulfilled, dispatched and delivered to you in time for your wedding day. Any delays or failure of items being delivered to you on time as a result of you failing to meet the cut off date will not qualify for a refund of any kind by ATW Creations.

 

Payment - General

9. Invoices submitted by ATW Creations to the Client are due within 30 days of receipt.

 

Payment for the Designs

10. For the Designs rendered by ATW Creations as required by this Agreement, the Client will provide payment (the “Design Payment”) to ATW Creations for the agreed flat fee.

 

11. A 50% non-refundable deposit of your quotation (the “Design Deposit”) will be payable to ATW Creations to secure your booking.

 

12. The balance of the Payment (the “Residual Design Payment”) will be payable upon approval for production of your order.

 

13. ​Revisions are not capped; however, ATW Creations reserves the right to charge for additional time where amendment requests are extensive, repetitive, or represent a significant departure from the originally agreed design concept. Any additional costs will be outlined and approved by the Client prior to further work being undertaken.

 

14. The Design Deposit is non-refundable under all circumstances. If the Client terminates the Agreement after work has commenced, ATW Creations reserves the right to invoice for work completed up to the termination date, less any amounts already paid.

 


Payment for the Prints (if requested)

15. For the Prints arranged by ATW Creations as required by this Agreement, the Client will provide payment (the “Print Payment”) to ATW Creations for an agreed fee.

 

16. 100% of the Print Payment will be payable to ATW Creations before any print production, assembly or delivery will take place.

 

Printing

17. If the Client wishes to instruct ATW Creations to arrange to print the Designs, ATW Creations cannot be held liable for any designs or information which are signed off (all approvals must be provided in writing, which includes emails) and subsequently printed with errors and will therefore not be liable for any resulting costs.

 

18. Please ensure you have requested the correct quantities of all stationery items before approving your design for print. Once your order has been sent to print, quantities cannot be changed. We recommend (for particular stationery items) ordering a few more than required to ensure you have spares. Re-printing designs is possible, however, small print runs are relatively more expensive and will be charged in full separately, before any re-prints are ordered.

 

19. ATW Creations will use reasonable care in selecting and liaising with third-party print suppliers. However, as printing is fulfilled by external providers, ATW Creations cannot guarantee print quality, colour accuracy, or delivery times. In the event of an issue, ATW Creations will liaise with the supplier on the Client's behalf to seek a resolution but cannot guarantee the outcome or accept liability for third-party errors. 

 

20. Please note colour variations between screen and print are unavoidable. ATW Creations does their best to ensure the colour is matched as accurately as possible. 

 

Ownership, Copyright and Intellectual Property

21. Once you have paid for your stationery in full you will become the owner of any products physically produced but you will not own the actual artwork created in the design process. Ownership and copyright of this artwork will always belong to ATW Creations. Unless expressly agreed by us in writing, ATW Creations remains the owner of all copyright and other intellectual property rights relating to the artwork and designs produced and delivered to you. You must not reproduce, share or otherwise use designs created for you for any other purpose than outlined in your initial order. 

 

22. All images, artwork and designs used across ATW Creations’ website or which have been sent to you via email or social media as proofs or printable files remain the sole property of ATW Creations and are subject to copyright laws and restrictions. Any use of images or artwork supplied belonging to ATW Creations must have authorisation to do so obtained in writing from ATW Creations and cannot be resold under any circumstances. ATW Creations reserves the right to refuse artwork should we feel the files are likely to breach any of these terms and conditions. ATW Creations does not supply artwork files to be printed outside of the business or at home unless it has been agreed with you in writing and full payment has been made.

 

23. ATW Creations reserves the right to use any of the Designs developed or produced under this Agreement within other designs. ATW Creations reserves the right to take photographs and keep hard copy samples of your design for promotional purposes and to use across the website and social media platforms.

 

24. All content on www.atwcreations.co.uk is the property of or licensed to ATW Creations, and is subject to copyright and other intellectual property laws.

Limitation of Liability

25. To the fullest extent permitted by law, ATW Creations' total liability arising under or in connection with this Agreement shall not exceed the total amount paid by the Client for the Services.

26. ATW Creations shall not be liable for any failure or delay in performing it's obligations where such delay or failure results from events beyond its reasonable control, including but not limited to illness, natural disasters, supply chain disruption, or courier delays.

 

Data Protection

27. ATW Creations will only request information needed to complete your order. In order to comply with the GDPR, ATW Creations keeps all client information, artwork and related information within a secure password protected environment i.e. locked computer and studio. Your information will only be shared when necessary with third parties such as delivery courier services. Client data will be retained only for as long as necessary to fulfil the order and for legal/accounting purposes.
